Privacy and personal information
KFC Kosovo undertakes to protect the privacy of any personal information provided to us by the User on our Web Sites and Applications. Any information sent on the Web Sites and Applications is subject to our Privacy Policy, whose terms we include here. Please read our Privacy Policy in order to familiarize yourself with our practices.
Law on Protection of Personal Data of the Republic of Kosovo 06 / L-082, CHAPTER II, LEGISLATION OF DATA PROCESSING, Article 5 – Legal processing of personal data paragraph 1 states that personal data may only be processed if the data subject has given his consent to the processing of his personal data for one or more specific purposes.
Thus, in accordance with the Rules for the Protection of Personal Data, KFC shall assume that the User has agreed to the Privacy Policy when he or she expresses his or her willingness by “clicking”, “clicking on”, “touching” (or other like terms), the Terms and Conditions of Use and going on to accept. It is necessary to agree to the Terms of Use in order to carry out the activities described on KFC’s Kosovo Web Site.
Please be assured that KFC Kosovo has taken every technical, organizational and legal measures necessary to guarantee the strict confidentiality of its customers’ private information and to prevent any unauthorized access, loss or destruction by third parties or KFC Kosovo employees.
Authorization and the Gathering of personal information
KFC Kosovo only gathers your identifiable information, such as name, address, phone number, email address, and information indirectly provided by the User, such as “cookies” (domain name, IP number and information about the pages accessed). This information shall be incorporated into KFC Kosovo customer database.
KFC Kosovo will use the information granted to it in order to provide the products and/or services requested, deal with any queries or complaints made and follow these up, process advertising and product information, relevant news about the brand and/or special deals. This also authorizes KFC Kosovo to use the personal information provided to invite you to take part in our contests, give you gifts, invite you to fill in our satisfaction questionnaires, to carry out internal management and administration of our list of customers and Users; and to develop marketing studies or business research or statistics.
KFC Kosovo may share your personal information with the sole purpose of complying with the aims for which it was authorized, there being no possibility of said information being used for any other non-consensual purpose. In addition, KFC Kosovo may share your personal information with third parties both within and outside the national territory, but only in the following circumstances:
To provide your personal information to third parties responsible for the maintenance and administration of the web pages, social network accounts, call centers, Internet service providers, etc. who attend to carrying out the activities for which the personal information will be used.
We can also provide personal information to Public Administration bodies, as long as said body has requested the information in order to comply with its duties. This includes the obligation to provide information when requested to do so by the authority in order to develop judicial and/or administrative proceedings.
Your acceptance
When you use and/or visit any Web Site or Application operated by KFC Kosovo, you indicate your acceptance of the Terms of Use and Privacy Policy, which are included by reference in this document. If you do not agree with any of these terms, please do not use the Web Sites or Applications.
KFC Kosovo Site and Applications
These Terms of Use are valid for all Users of the Web Sites and Applications, including Users who also contribute with video content, information and their material or services on the Web Sites or Applications. The Web Sites and Applications may include links to third party Web Sites which neither belong to nor are controlled by KFC Kosovo. KFC Kosovo has no control whatsoever over, and does not accept responsibility for, the content, privacy policies or practices of any third-party Web Site. KFC Kosovo will not censor or edit the content of any third-party web site, nor is it authorized to do so. The User, when using the Web Sites or Applications, expressly absolves KFC Kosovo of any responsibility arising out of the use of any third-party Web Site. As such, we recommend that, when exiting the KFC Kosovo Web Sites or Applications, you check and read both the terms and conditions and privacy policy of any other web site you visit.
Access to Web Sites/Applications
KFC Kosovo hereby grants its authorization for the User to use the Web Sites in accordance with the provisions of these Terms of Use, upon the condition that: (i) you use the Web Sites and Applications, as authorized, solely for personal, not commercial, use; (ii) you do not copy or distribute, either in full or in part, the Web Sites or Applications via any medium, without the prior written authorization of KFC Kosovo; (iii) you do not alter or amend, either in full or in part, the Web Sites or Applications; and (iv) you comply with the terms and conditions of these Terms of Use.
The User agrees that he or she shall not use or run any automated system, including, but without being limited to, “robots”, “spiders”, offline readers, etc. which access the Web Sites or Applications and send a quantity of request messages to the KFC servers over a period of time which is greater than the quantity one person can reasonably send over the same period of time with a browser on a conventional line. Notwithstanding the foregoing, KFC Kosovo does authorize public search engine operators to use “spiders” to copy material from the site with the sole purpose of creating search indexes for material but does not authorize them to save this material in the cache or to store it. KFC Kosovo reserves the right to rescind these exceptions, whether in general terms or in specific cases. The User acknowledges that he or she shall not compile or collect any personal information, including account names, from the Web Sites or Applications, or use the communications systems provided by the Web Sites or Applications to promote the sale of products and/or services. The User agrees that he or she shall not make contact, for commercial purposes, with the Users of the Web Sites or Applications with regard to their submissions from users (as defined below).
Intellectual Property
The content of the Web Sites and Applications, including, but without being limited to, text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like (“Content”) and any brand names, service marks and logos which feature therein, are the property of KFC or have been licensed to KFC Kosovo for its use, subject to copyright and other intellectual property rights, in accordance with the law on Intellectual Property 03/L-170 Republic of Kosovo and international conventions.
The Content of the Web Sites and Applications is presented at face value, solely for your personal information and use, and may not be used, copied, reproduced, distributed, transmitted, exhibited, sold, licensed or exploited in any other way with any other purpose, without the prior written consent of their respective owners. KFC reserves all rights not expressly granted, and with regard to the Web Sites, Applications and Content. The User agrees that he or she shall not use, copy or distribute any part of the Content not expressly authorized by this document. If you download or print a copy of the Content for personal use, you should retain all the copyright and property rights notices included in this document. The User undertakes not to bypass, disable or interfere in any other way with the security features of the Web Sites and Applications, or the features which prevent or restrict the use or copying of any Content, or which impose limitations on the use of the Web Sites and Applications or their Content.
Disclaimer of warranties
The User agrees that the use of KFC’s Web Sites and Applications shall be at his or her own risk. To the fullest extent permissible pursuant to the applicable law, KFC, its officials, directors, employees and agents disclaim all warranties, whether express or implied, in respect of the Web Site and their use thereof. KFC does not issue any representations or warranties regarding the accuracy and integrity of the content of this site, or the content of any site linked to it.
Limitation of Liability
Under no circumstances shall KFC, its officials, directors, employees or agents be liable to the User for any direct, indirect, incidental, special, punitive or consequential damage of any kind arising from any (i) errors or inaccuracies in the Content, (ii) personal injuries or damage to property of any type, which may result from your access to and use of our Web Sites or Applications, (iii) unauthorized access to or use of our secure servers and/or of part or all of the personal information and/or financial information stored therein, (iv) interruption to or halting of transmission to or from our Web Sites or Applications, (v) software errors, viruses, Trojans or the like which may be transmitted to or via our Web Sites and Applications by any third party, and/or (vi) error in or omission of any content or due to any loss or damage of any kind incurred as a consequence of the use of any content published, sent by email, transmitted or in any other way made available through the Web Sites or Applications, whether based on a warranty, contract, unlawful act or any other legal theory, and whether or not the company has been warned of the possibility of said damage. The aforementioned limitation of liability shall apply to the fullest limits authorized by the law in the applicable jurisdiction.
You specifically acknowledge that KFC shall not be liable for the defamatory, offensive or illegal conduct of any third party, and that any risk of damage arising out of the above is entirely of your responsibility.
Indemnity
The User agrees to defend, indemnify and hold harmless KFC, its parent companies, directors, employees and agents against any and all claims, damages, obligations, losses, costs or debt and expenses (including, but without being limited to, the attorneys’ fees) arising from: (i) your use and access to the Web Sites and Applications; (ii) your breach of any of the Terms of Use ; (iii) your breach of the rights of any third party, including, but without being limited to, the copyright, property or privacy rights. This duty to defend and indemnify will outlast these Terms of Use and your use of the Web Sites and Applications.
Ability to agree to the terms of service
The User acknowledges that he or she is above the age of 18, or an emancipated minor, or that he or she has the legal consent of a parent or tutor, and that he or she is fully able and competent to agree to the terms, conditions, obligations, representations, claims and warranties set forth in these Terms of Use, and to adhere to and comply with them.
Assignment
These Terms of Use and any right and license granted by this document may not be transferred or assigned by you but may be assigned without restriction by KFC.
Arbitration
Due to the mutual benefits (such as reduced expense and increased efficiency) which the private binding arbitration can offer both the User and KFC, the User and KFC’s acknowledge that any claim, dispute and/or controversy in some way related to their use of the Web Sites and Applications, or to any product sold by KFC or via the Web Sites or Applications, shall be submitted and determined exclusively through arbitration court which shall meet in the city of Pristina Republic of Kosovo.
Changes to the Terms of Use
KFC Kosovo reserves the right to change these Terms of Use at its sole and absolute discretion, with or without notice to the user, and it is your responsibility to review these Terms of Use in the event of any changes. Use of the Website and Applications after any modification of these Terms of Use will indicate your consent and acceptance of the revision of these Terms and Conditions and the User is obliged to comply with them.
